1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your access to and use of Designed For Longevity.
In these Terms, the term "Service" refers to the Designed For Longevity website, intake process, coaching platform, WhatsApp-based communications, content, recommendations, and related services that we provide.
By accessing or using the Service, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree to these Terms, you should not use the Service.
2. Description of the Service
Designed For Longevity is a behavior-based coaching service designed to support health habits, nutrition, movement, sleep, stress management, weight management, and general wellness.
The Service may include personalized coaching messages, educational content, habit-building guidance, progress tracking, AI-assisted recommendations, and related support delivered through digital communication channels, including WhatsApp.
3. Eligibility
The Service is intended only for individuals who are at least 18 years old. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.
4. Health and Medical Disclaimer
Designed For Longevity is an educational and behavior-based coaching service and does not provide medical advice, diagnosis, treatment, medical monitoring, or healthcare services. Use of the Service does not create a physician-patient, therapist-patient, dietitian-patient, mental health provider-patient, or other professional-client relationship.
Additional information regarding the health-related limitations of the Service is provided in our Health Disclaimer, which is incorporated into these Terms by reference.
5. Emergencies
The Service is not intended for emergency situations.
If you believe you are experiencing a medical emergency, mental health crisis, or any situation requiring immediate professional assistance, call emergency services or contact an appropriate healthcare professional immediately.
Do not rely on the Service for emergency support.
6. AI-Assisted Coaching
Designed For Longevity uses artificial intelligence technologies to help generate coaching insights, recommendations, summaries, and personalized responses.
AI-generated content may be incomplete, inaccurate, outdated, or inappropriate for your particular circumstances. You should use your own judgment and consult qualified professionals when appropriate before acting on information provided through the Service.
7. User Responsibility
Designed For Longevity provides educational information, coaching support, habit-building guidance, and AI-assisted recommendations. You remain solely responsible for evaluating, implementing, modifying, or disregarding any recommendation provided through the Service.
You acknowledge that the Service uses artificial intelligence technologies to generate coaching messages, recommendations, summaries, and other content. Artificial intelligence systems may produce information that is inaccurate, incomplete, outdated, misleading, or inappropriate for your particular circumstances. You agree to exercise independent judgment and remain solely responsible for evaluating any information provided through the Service before acting upon it.
Your decisions regarding nutrition, exercise, sleep, supplementation, medical care, lifestyle habits, and other health-related matters are your own responsibility.
You acknowledge that meaningful results depend on numerous factors beyond our control, including consistency, adherence, individual circumstances, health status, environment, and personal choices. You are solely responsible for your actions and outcomes.You assume all risks associated with actions taken or not taken based on information provided through the Service.
8. Results Disclaimer
Results may vary among individuals and depend on numerous factors, including adherence to recommendations, consistency of implementation, health status, genetics, medications, environment, and personal circumstances.
Because many of these factors are outside our control, and because implementation decisions remain your responsibility, Designed For Longevity does not guarantee weight loss, body composition changes, habit formation, improved biomarkers, improved health outcomes, increased energy, or any other specific result.
Testimonials, examples, or educational content, if provided, are not guarantees that you will achieve the same or similar results.
9. Subscriptions, Billing, and Cancellation
The Service may be offered on a subscription basis. Subscription fees, billing intervals, and any applicable promotional terms are displayed at the time of purchase.
Subscriptions renew automatically unless canceled before the next billing date. You authorize us and our payment processors to charge the payment method you provide for recurring subscription fees and any applicable taxes.
You may cancel your subscription at any time by contacting us at info@virtualhealthsystem.com. Unless otherwise stated, cancellation will take effect at the end of the current billing period, and you will continue to have access to the Service until that time.
10. Refunds
Subscription fees are generally non-refundable. However, we may, in our sole discretion, provide refunds, credits, or other accommodations in individual circumstances.
11. Intellectual Property
The Service, including its website, content, coaching framework, text, design, branding, software, workflows, recommendations, and related materials, is owned by or licensed to Virtual Health Systems LLC and is protected by applicable intellectual property laws.
You may use the Service for your personal, non-commercial use only. You may not copy, reproduce, distribute, modify, sell, resell, or exploit any part of the Service without our prior written permission.
12. Acceptable Use
You agree not to misuse the Service, interfere with its operation, attempt to access systems or data without authorization, use the Service for unlawful purposes, harass or abuse others, submit false or misleading information, attempt to reverse engineer or copy the Service, or use the Service in a way that could harm us, other users, or third parties.
13. Suspension and Termination
We reserve the right to suspend, restrict, or terminate access to the Service at any time if we reasonably believe that a user has violated these Terms, misused the Service, engaged in unlawful activity, or created risk or harm to other users, our business, or third parties.
We may also suspend or terminate access if payment fails, a subscription is canceled, or continued use of the Service is no longer appropriate in our judgment.
14. Third-Party Services
The Service relies on third-party providers for payment processing, communications, hosting, data storage, artificial intelligence services, security, technical operations, and other operational functions.
We are not responsible for third-party services, platforms, outages, delays, errors, or acts or omissions outside our reasonable control.
15. Changes to the Service and Terms
We may modify, update, suspend, or discontinue all or part of the Service at any time.
We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and may provide additional notice where appropriate.
Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
16. Individual Claims
To the fullest extent permitted by law, any claim arising out of or relating to the Service must be brought in an individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or similar proceeding.
17. Limitation of Liability
To the fullest extent permitted by applicable law, Designed For Longevity, Virtual Health Systems LLC, and their owners, officers, directors, employees, contractors, affiliates, licensors, successors, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including loss of profits, loss of data, loss of goodwill, personal injury, emotional distress, business interruption, or any other damages arising out of or related to the use of, inability to use, or reliance upon the Service.
You acknowledge that the Service provides educational information, coaching support, and AI-generated content that may be incomplete, inaccurate, or inappropriate for your particular circumstances. You assume all risks associated with your use of the Service and any actions taken based on information provided through the Service.
In no event shall the aggregate liability of Designed For Longevity or Virtual Health Systems LLC exceed the greater of the total amount paid by you to us during the twelve (12) months preceding the event giving rise to the claim or one hundred U.S. dollars (US $100).
18. Governing Law
These Terms are governed by the laws of Puerto Rico, without regard to conflict of law principles.
